(iii) is the result of acts or omissions of a third party which were unforeseeable or unavoidable.
7.6 All complaints should be made, or any incidents likely to lead to a claim, must be notified initially at the time of the occurrence to Snow Train staff, station staff or REL representatives to allow immediate steps to be taken.
7.7 Applications for refunds for alleged failure, or non-performance of the contract must be submitted in writing to REL within 28 days of the date of travel. You must obtain a suitable endorsement of Your ticket by an appropriate representative of Eurostar (UK) Limited or SNCF (whichever is relevant) either on board the Snow Train, at the destination station or from an REL representative and enclose this endorsed ticket with Your application.
8.1 For Your peace of mind REL strongly recommends that You take out appropriate insurance cover so that You may benefit from cancellation cover and protection against those risks including theft, loss of or damage to Luggage, for which REL does not accept liability under these Conditions.
9.1 You must comply with check-in and boarding times shown on Your travel documents. If You do not You may not be allowed to join the Snow Train and Your ticket may be invalidated.
Whilst every effort is made to assist disabled passengers, REL cannot guarantee the provision of special facilities in terminals, stations or on board the trains. For operational and safety reasons, REL regrets that wheelchairs cannot be used on the Snow Train.
It is Your responsibility to ensure that You have valid passports or other valid travel documents and that You have all necessary visa(s) or other immigration documents (if required) for travel to or through France. Neither REL nor Eurostar (UK) Limited nor SNCF or any other service provider accept liability if You cannot travel because You do not have the correct documents.
12.1 If Your ticket is lost, spoiled or tampered with it is invalid for travel and You should (in the case of a spoiled or tampered ticket) return it to REL or Your Travel Agent immediately. REL may issue a replacement ticket on payment of an administration fee of £20 (except where the loss, spoiling or tampering is the result of REL’s negligence). However REL reserves the right to refuse to issue a replacement ticket where it is reasonable to do so.
12.2 In view of the fact that promotional material is necessarily prepared some time in advance, information may change, particularly, with regard to dates and times of services. Therefore changes may be made to the particulars contained in any promotional material at any time before the contract with You is made. In these circumstances REL will notify You of such changes at the time of booking.
12.3 Statements made by or on behalf of REL shall not be binding upon REL unless or until made in writing and issued or signed by a duly authorised employee of REL.
12.4 You must comply with all customs regulations and bylaws enforced from time to time by, and with all the regulations of, any competent authorities regarding passengers, Luggage or other property. REL or third parties may, at any time, alter any information or regulations referred to without notice.
12.5 You agree not to act in a manner likely to endanger any person or property and to obey all reasonable directions given by REL or its servants or agents for the purpose of ensuring the safety, efficiency or regularity of any trains. REL reserves the right to refuse any person access to/ask them to leave any train or platform if they are behaving or, in REL’s sole opinion are likely to behave in a riotous, disorderly or offensive manner.
12.6 You may only travel in Your allocated seat on the Eurostar and Your single berth couchette in Your Compartment.
12.7 Children aged under 18 at the time of travel may only travel on the Snow Train if accompanied by an adult. If You are travelling with babies or infants under 18 months, REL recommends that the baby sleeps in a baby car carrying seat. For children aged between 18 months and 4 years REL recommends that they sleep on the lower berth of a Compartment with an adult.
12.8 You will comply with such checks, inspections and searches as may be required of You by either REL (its servants or agents) or any competent authorities as the same may be considered necessary or desirable for the safe and/or secure and/or efficient and regular operation of the service. You fail to comply with such requirements entirely at Your own risk and REL accepts no liability for the consequence of Your failure to comply with the regulations.
12.9 Without prejudice to any other provisions in these conditions, non-compliance with any of the requirements set out in Clauses 12.4 through to 12.8 and Clause 12.10 shall be a ground for refusing travel and REL accepts no liability for the consequence of You being refused travel.
12.10 No hazardous goods (such as loaded firearms, explosives, toxic, radioactive or infectious goods) livestock, animals or pets will be accepted for carriage.
12.11 If You leave any Luggage on a train REL will not be responsible for any loss, damage or delay resulting from the loss of that article. If Luggage is left on a train REL may open it and examine the contents before removing it to a secure place. REL may without liability remove or destroy any Luggage or its contents and any other property which might in its reasonable opinion cause injury or inconvenience to persons or damage to property.
12.12 Any left Luggage not claimed within 3 months of it being found will be considered abandoned and then may be sold or otherwise disposed of and the proceeds retained by REL. Perishable goods will be disposed of earlier. REL may charge for the return of any lost or unclaimed Luggage.
